(in Polish) Human Rights in Criminal Proceedings 1300-OG-HRINCP-FS

In the course of the presentation of the lecture matter, the following issues will be discussed:
1. Introduction to human rights (the evolution of human rights, sources of human rights, negative vs. positive rights, human rights in domestic law order, international and regional systems of human rights protection) (4 hrs)
2. European Court of Human Rights (history, structure, judges, submitting an application to ECHR, procedure and decisions) (3 hrs)
3. Human Rights in criminal proceeding (e.g. the right to fair trial, principle of equality before the law, principle of presumption of innocence, the right to be treated with humanity and the right to freedom from torture, the right to legal assistance) (8 hrs)
4. ECHR judgements and decisions (5 hrs)

Total student workload

Contact hours with teacher: - participation in lectures – 20 hrs - consultations – 10 hrs Self-study hours: - preparation for lectures – 30 hrs - reading literature – 60 hrs - preparation for examination – 30 hrs Altogether: 150 hrs (6 ECTS)

Student: W1: defines and explains the basic concepts of human rights in criminal justice context W2: has knowledge of theories of human rights W3: has knowledge of sources of human rights and their interpretations W4: is able to identify the development trends of ECHR judgements and decisions in criminal justice context

Student: U1: has the ability to classify human rights in criminal justice context U2: is able to interpret legal text and presenting legal arguments in criminal justice context U3: can analyze, explain and resolve basic human rights issues in the context of the criminal proceedings

Student: K1: knows the limitations of his/her own knowledge and understands the need for further education in criminal justice context K2: is aware of the changing reality and the need to protect human rights in criminal proceedings K3: is able to work independently analyzing the presented materials in criminal justice context and formulate certain answers and observations based on them

- test (single choice, only one answer correct to each question, no negative points for failed questions) – W1,W2, W3, U1, U2, U3
- activity – K1, K2, K3

Assessment criteria:
fail- 0-4 pts (0-49%)
satisfactory- 5 pts (50%-59% )
satisfactory plus- 6 pts (60%-69%)
good- 7 pts (70%-79%)
good plus- 8 pts (80%-89%)
very good- 9-10 pts (90%- 100% )

Student's active participation during the classes/discussion is a subsidiary mean of assessment and allows to raise the sum of points. Students are obliged to prepare presentation about chosen ECHR judgment.
