Alternative Dispute Resolution in Polish Legal system 1300-ADR-PLS-KPP
The concept of alternative legal dispute resolution is based on the assumption that there are many different methods of resolving this type of dispute and that court proceedings are not the only possible approach. A modern lawyer should be aware of the existence of alternative methods to court proceedings and be able to select a dispute resolution method depending on the stage or type of dispute. Mediation occupies a special place among the methods of alternative dispute resolution.
The lecture concerns Polish experiences in the field of implementing the concept of alternative dispute resolution, with particular emphasis on mediation available in each of the legal proceedings: civil, criminal and administrative.
Therefore, the lecture will explain the basic concepts related to the concept of ADR and individual dispute resolution methods, including such as negotiation, mediation and arbitration. Then, students learn about the legal regulations on mediation included in the Code of Civil Procedure, the Code of Criminal Procedure and the Code of Administrative Procedure.
